Judicial Mediation

Mediation has become a valuable tool for resolving legal conflicts. It allows for effective and lasting agreements without necessarily resorting to a full judicial process. At Muñoz e Infantes Abogados we are committed to consensual solutions when they are possible and advantageous for our clients, always with a clear understanding of their rights and legal limits.

In contexts where conflict intensifies, mediation offers a neutral space based on dialogue, making it easier for the parties to regain control of the situation and make decisions about their own issues. This process fosters more constructive relationships and avoids the total confrontation that sometimes occurs in litigation.

We intervene both in intrajudicial mediation when there is already an ongoing proceeding and the judge refers the matter to mediation, and in extrajudicial mediation when the parties wish to explore a solution before going to court. In both cases, our role is to protect the client’s interests and guide them through the process.

Mediation proves especially useful in civil and family law disputes, as well as in property, community, or contractual disputes. In these areas, direct negotiation can avoid lengthy court processes, reduce costs, and contribute to a more cooperative atmosphere between the parties.

The procedure is confidential: nothing that is disclosed in mediation can later be used in court if no agreement is reached. This guarantee allows the parties to communicate freely, explore alternatives, and seek a solution that meets everyone’s needs.

In addition to its speed and lower cost, mediation allows for personalized agreements that better fit the reality of the conflict than a decision imposed by a judge. This increases the likelihood that the terms of the agreement will be fulfilled without incidents.

From a judicial standpoint, mediation helps to reduce the backlog in the courts, promoting a more agile and accessible justice. But, above all, it brings greater well-being to the parties, who find a resolution with less emotional and economic strain.

In our practice, we analyze each case to determine whether mediation is advisable or, on the contrary, litigation is unavoidable due to the nature of the conflict or the attitude of the opposing party. Our advice always begins with a realistic assessment of the expectations of each path.

If an agreement is reached, it can be elevated to a public deed or submitted for judicial homologation, thereby acquiring full enforceability. In this way, the client obtains a solution as secure as a judgment, but in much less time.

At Muñoz e Infantes Abogados we view mediation as an opportunity: when dialogue is viable, it is possible to transform the conflict into a useful agreement, preventing the dispute from dragging on and becoming more complicated. Our objective is to accompany the client with legal defense, strategy, and the most suitable approach in each situation.
